Lawyers might argue that point as it's referred to in the novels as "The Shire".  However, it's not really the lawyers that are as concerning as it is to keep aligned with the new name...although, it's not like the Deadcat guys were the least bit concerned there.

The Shire does not belong to J.R.R.Tolkien.
